To book a room at our acom Hotel Vienna you must be at least 18 years old. For your booking we need the data of your credit or debit card. Meals are not included in the room price. You can add breakfast when you book or during your stay.
If you have not paid in full for your room and additional extras of your booking at the time of booking, you will have to make the payment on the spot at the hotel.
All extras purchased during your stay with us must be paid for separately at the time of purchase. In this case, the price indicated at the time of purchase applies.
We accept the following credit and debit cards: Visa, MasterCard, American Express and Maestro. The expiration date of your card must be after the end of your stay. Your card will be charged immediately after payment.
Payment at the hotel can also be made in cash. We do not accept cash checks or other forms of payment.
A withdrawal from the contract concluded with us or a cancellation of a booking made is only possible if a right of withdrawal/cancellation has been expressly agreed, another statutory right of withdrawal exists or if we expressly agree to the cancellation of the contract. The agreement of a right of withdrawal/cancellation as well as the possible consent to a cancellation of the contract must be made in text form. If there is no right of withdrawal/cancellation, the agreed price shall be payable even if the customer does not make use of contractual services.
If a date for withdrawal from the contract or cancellation has been agreed in writing, the customer may withdraw from the contract until then without triggering claims for payment or damages. The customer’s right of withdrawal expires if the right of withdrawal is not exercised in writing by the agreed date. If a right of withdrawal or cancellation has not been agreed or has already expired, there is also no statutory right of withdrawal or cancellation and the hotel does not agree to a cancellation of the contract, we retain the right to the agreed remuneration despite the non-utilization of the service.
In the case of unused rooms, the income from renting the rooms to other parties and the saved expenses will be credited.
We can lump sum the damage incurred and to be compensated. 90% of the contractually agreed price for overnight stay with or without breakfast must be paid in this case.
We may cancel your booking with written notice (including email) at any time with immediate effect if
– You fail to make any payments required by us by the due date, or
– You otherwise materially breach or have materially breached your current or any past contract with us.
We reserve our legal rights in respect of your breach of contract if we cancel your booking due to your fault.
In the event of circumstances beyond our control (including strikes, explosions, fires, floods, power outages, water supply disruptions and emergency evacuations, regulatory requirements due to pandemics), and due to which we are unable to provide a room for you, we may cancel your booking. In this case we will notify you immediately, and
– if you have already paid for your room in full, we will refund the full price; or
– if you have not yet paid for your room, you will not be required to make any payment to us.
Brand Change or Renovation:
We may also cancel your reservation if we make a brand change or renovation to the hotel in question and therefore we cannot guarantee your room. In this case, we will notify you at least 1 week before the date of your reservation, and
– if you have already paid for your room in full, we will refund you the full price; or
– if you have not yet paid for your room, you will not be required to make any payment to us.
Except as provided above, we will not be liable or responsible for any failure or delay in performance of our contractual obligations if caused by events beyond our control.
This does not affect your mandatory rights provided by law.
Rooms are available from 15:00 on the day of arrival. Please inform the booked acom hotel if you expect to arrive after 23:00 local time.
Guests will be asked to provide identification and proof of citizenship at check-in. You may be asked to fill out a registration form Foreign guests are required by law to provide their ID number. The following identification documents are accepted: Passport or ID card or equivalent national valid identification documents for international guests.
Rooms must be vacated by 11:00 am local time on the day of departure. If you do not vacate your room by this time, a “late check-out” fee of EUR 25 may be charged.
You, and in the case of a group booking, the members of your group, may not resell or transfer any booking (or any part thereof). In addition, you, and in the case of a group booking, the members of your group, may not advertise, market or otherwise offer for sale any of our rooms, either independently or as part of a combined offer. We will not accept any bookings made in this manner and will not be liable for them.
The following is prohibited:
Threatening or insulting the hotel team before, during or after your stay;
Smoking on the premises of our hotel. This includes smoking e-cigarettes. Smoking areas are designated on site. Smoking on the premises of our hotel outside of designated smoking areas will be subject to a fine of €250 – we will set this amount higher or lower if higher or lower cleaning costs have been incurred or higher or lower damage has been caused;
causing a danger to the health and safety of one of our team members or our guests;
Bringing pets onto the premises of our hotel, with the exception of assistance dogs that are labeled as such;
Engaging in unlawful activities (e.g., ingesting illegal substances) during your stay at our hotel;
Bringing potentially hazardous substances and items onto the premises of our hotel;
using electrical appliances that may set off the fire alarm, such as toasters, electric stove tops and grills;
Tampering with the fire alarm and other emergency equipment;
Removing, damaging or destroying any property of our hotel;
The use of technology provided by our hotel to download or access unauthorized or obscene content; and
unreasonably harassing other guests or staff of our hotel.
If you, or in the case of a group booking, any member of your group, cause any damage or loss to the property of the hotel or other guests, you (as the person making the booking in the case of a group booking) will be responsible for the damage or loss and liable to pay us on demand the amount necessary to make good or remedy such damage or loss.
If you, or in the case of a group booking, any member of your group, cause damage to the property of the hotel, other guests or their property, or otherwise materially breach these T&C, we reserve the right:
Cancel your booking with immediate effect and (if necessary) remove you, and in the case of a group booking, your group, from the property;
retain any amounts paid by you or charge you the full amount for your booking (but provided that you do not prove that our damages and compensation are actually less than the amount charged); and/or
refuse future bookings from you and/or refuse you access to accommodation at our hotel.
We shall not be obliged to make any refunds or pay any damages in such cases.
Our statutory liability for damages is limited as follows:
We are liable with respect to damages based on a slightly negligent breach of essential contractual obligations (“cardinal obligation”, i.e. an obligation the fulfillment of which makes the proper performance of the contract possible in the first place, the breach of which jeopardizes the achievement of the purpose of the contract and the observance of which you regularly rely on) only up to the amount of damages that are typically foreseeable at the time of the conclusion of the booking contract;
We do not assume liability for damages resulting from a slightly negligent breach of non-essential contractual obligations.
This limitation of liability does not apply in cases of mandatory legal liability (for example, liability under the Product Liability Act and the innkeeper liability under § § 970 et seq ABGB), in the event of the assumption of a guarantee, liability for damage caused by an intentional or grossly negligent act or culpably caused bodily injury.
Photos on our website and in our brochures are for information and illustration purposes only. They are not a guarantee of any particular condition or furnishings or floor plan of the rooms you have booked. Although every effort has been made to ensure that the impression conveyed by photographs, graphic representations and text of the accommodation and services offered at our hotel is as reliable as possible, due to the large number of rooms or due to changes in furnishings, the brand of the hotel or renovations, there may be discrepancies between the room depicted and the room actually booked. In this respect, you have no grounds for complaint.
Unless you are a consumer and to the extent permitted by law, we shall not be liable to you for:
– lost revenue;
– lost business opportunities,
– business interruption;
– loss of profits or contracts;
– lost savings;
– Loss of data;
– Loss of reputation and/or loss of goodwill;
– Management or office time spent in vain.
Unless you are a consumer and we are liable to you, our liability (to the fullest extent permitted by law) whether in contract, tort (including negligence) or for breach of a legal duty shall in no event exceed the total price of your booking.
You shall take all reasonable steps to mitigate any loss.
We reserve the right to:
– Change your room assignment and/or hotel location at any time during your stay for any reason; or
– Cancel your booking(s) due to health and safety concerns or full or partial closure of the hotel. If we have to cancel your booking(s), we will try to notify you and a full refund will be initiated to the same debit / credit card. However, it may take a few days for the credit to arrive in your account.
Applicable law/jurisdiction
If you are a corporate customer, it is hereby agreed that the laws of the Federal Republic of Austria shall apply to these GTC, their subject matter and their formation (and to non-contractual claims or disputes), as well as to their interpretation, and that the courts of Frankfurt am Main shall have non-exclusive jurisdiction over any claims arising out of or in connection with your booking and/or stay at one of our hotels.
We reserve the right to assert claims for breach of these TOS in your country of residence or any other country with which you have a connection, if applicable.
If you are a consumer, you may have certain rights under applicable consumer protection laws. Such rights remain unaffected by these GTC.
Severability clause
If any provision of these TOS is held to be invalid, illegal or unenforceable, that provision shall be deemed deleted and shall not affect the validity and enforceability of any remaining provisions. Any failure by us to exercise any of our rights or remedies under these TOS or otherwise shall not be deemed a waiver by us of such or any other rights or remedies.
